Question

Asked 5/6/2009

Can my mortgage contract be changed, after i signed. 3 months after i signed they told us we needed flood insurance, which when signed we did not need

It. Our mortgage was sold the day we signed to chase. In our contract there was a certificate from vist bank saying we were not in a flood zone. If we were we would never have signed the contract, because our payments would have been too high. Nothing has changed with fema since 1986 on this parcel. Chase in december tacked on 1500.00 for the past year and 1500. this year which upped our mortgage way over our debt to ratio now we cannot afford the payments. Can they change your contract like this and can we fight this. thank you

If they do not have on the contract you signed that they require flood insurance or something allowing them to require it in the future, They can't just decide out of nowhere that they want it.
read your contract carefully, Stand your ground, You run this show.

Our contract says in plain words No to flood insurance, the only way they can make us get it is if something changed in FEMA, which we checked into FEMA and there were no changes in the parcel since 1986. But what kind of lawyer and who would i take this to, we need to fight before we loose our house. Chase told us we need engineers to come in but who has the money to do that. Not us! Even to hire a lawyer Chase killed us on savings by putting our mortgage up over 400 a month, so i need a lawyer to tell me if its possible to fight this. I want to stand my ground but we did get a lawyer and he wrote chase a certified letter and they said they never got it. Also they lied about FEMA, they claimed fema contacted them and that is not true. FEMA does not contact anyone..We were told that by FEMA itself. Also Where did Vist bank get the document certificate that told us we did not need flood insurance how can one bank get a certificate that says no from fema and then another bank telling us we need it. WE NEED A GOOD LAWYER...Also i think the realtors should also take responsibility too for putting in the listing that no flood insurance was required. If someone knows of a good lawyer, that we could get advice about this please let us know.......

One other thing, at closing the first thing out of our mouths was clarification that we did not need flood insurance, because if we did we were not goin to sign. And we were told right out no they went through the Department of Homeland Security Federal Emergency Management Agency Standard Flood Hazard Determination.....
